ONLINEART TERMS OF SERVICE

Welcome to OnlineArt a Internet art gallery located at http://www.onlineart.org.uk (the "Site") where people and organizations can buy and sell original works of art and crafts (the "Art") online and participate in an online art community (the "Services"). The Services are provided by OnlineArt to you subject to the following terms and conditions

Acceptance of Terms.

Before you use the Services, we require that you read and accept these Terms and conditions. If you visit, shop, or otherwise participate in the Services on the Site, you accept these Terms and Conditions. If you choose not to accept these Terms of Service, you may not access or otherwise use the Site or Services. If you have any questions regarding these Terms of Service, please contact our Customer Service department by going to http://onlineart.org.uk/#/contactus/4532453598. In addition, when using particular OnlineArt owned or operated services, you shall be subject to any posted policies, guidelines or rules applicable to such services. All such policies, guidelines and rules are hereby incorporated by reference into the Terms and Conditions.

Amendment.

We may, at our discretion, change, modify, add or remove any portion of these Terms of Service, in whole or in part and at any time without notice to you, by posting such changes on the Site.

These terms and conditions form a legally binding agreement between You and OnlineArt meaning Anton Psak. Your statutory rights are not affected.

PARTICIPATION AGREEMENT


Acceptance of Art Seller

OnlineArt reserves the right to accept or decline your application to market Artworks through OnlineArt. Your application includes your acceptance of these terms and conditions.

You agree to have your artworks and descriptive information displayed on OnlineArt. You must ensure that all your information is accurate and up to date. Please inform OnlineArt of any changes in the stored information including name, address and contact details, pricing of Artworks, and the Sold status of Artworks.

The Services are available only to individuals who can form legally binding contracts, you must be over 18. Registered businesses are represented by one person with the authority to abide by these Terms and Conditions. You must be a Registered User, subscribed with a valid credit card to one of our membership plans.

Acceptance of Artworks

OnlineArt reserves the right to accept or decline your application to market any Artwork through OnlineArt for any reason at our sole discretion. When accepted, your Artwork may be listed on the site for the entire time you are a registered user. The seller may remove the Art from the Site at any time. If a sale is made you are entering into a legally binding contract with OnlineArt to complete the sale and dispatch the artwork in the agreed time.

You may market Your Artwork through other channels simultaneously with marketing through OnlineArt. You must ensure your ability to fulfill OnlineArt orders is unaffected, you don’t undercut your OnlineArt prices and pieces are removed from the site if they are sold elsewhere.

The copyright in the Artwork will remain with you even after ownership of the Artwork is transferred to the Customer. Your work must be free of any copyright restrictions or intellectual property disputes.

Illustrative Images

You must supply at least two high-quality digital Images of each Artwork You wish to sell through OnlineArt: a Gallery Image and a Detail Image. The Images must be in JPEG format. The Gallery Image will show the entire artwork including frame (if framed) and the Detail Image will show a portion of the artwork to illustrate the grain of the canvas. The width of the Gallery and Detail Image will be at least 600 pixels.

Pricing and Delivery

You will price the Artwork which must be inclusive of VAT (if applicable), delivery, insurance costs and OnlineArt's commission. OnlineArt will notify you in advance of the commission rate once accepted You must sell the artwork at the accepted price.

Materials, packaging, delivery and insurance costs cannot be reclaimed from OnlineArt under any circumstances and should be taken into account when pricing Your Artworks.

You will ensure that Artworks are securely packaged, labeled and adequately insured for safe delivery to the Customer. You will not include any contact details that would encourage the customer to deal directly with you via the packaging, such as business cards, leaflets, letters of solicitation for business etc.

You will package and arrange delivery of Artworks to the Customer within five working days of receiving the order. The Artwork must arrive with the Customer no later than 7 working days after the order has been received by You.

Should you become aware of any reason why an Artwork that has been ordered from You may not be received by the Customer within 7 days, You will notify OnlineArt immediately of the reason and expected length of the delay. OnlineArt will attempt to contact the customer and in some cases may offer a refund to the Customer resulting in the cancellation of the order.

Returns and damaged goods

In the event of the Artwork arriving damaged with the Customer, You will be liable for the costs of retrieving the artwork. You will claim any costs in retrieving the Artwork through the insurance cover provided by Your chosen courier. OnlineArt will not accept claims for reimbursement in the event of damage to Artworks under any circumstances.

You will be liable for the costs of retrieving the Artwork even if you haven’t got adequate insurance. You accept that the Customer may return the Artwork(s) within 14 days of receipt, and this will constitute cancellation of the order. OnlineArt will not accept liability for Your delivery expenses in this instance.

Payment for Artworks

Should Your Artwork(s) be sold We will raise a purchase invoice for the Price. The Invoice will be paid by OnlineArt no sooner than 28 days after OnlineArt have confirmed delivery of the Artwork(s) to the Customer. Payment will be made by cheque or bank transfer.

Ownership of Customer relationship

You agree that the business relationship between the Customer and OnlineArt is entirely owned by OnlineArt. You will not approach the Customer directly or correspond with the Customer in any way, except with express written authorization from OnlineArt. You will not sell directly to the Customer or allow a direct relationship to develop between You and the Customer that could be detrimental to OnlineArt. You will not pass Your contact details to the Customer, including in Artwork packaging.

In the event of a return or damaged goods claim, we will release Your details to the Customer.

Disclaimer

You agree to defend, indemnify, and hold harmless OnlineArt, its officers, directors, employees, agents, and third parties, from your use of the service, including any violation of these rules.
OnlineArt provides this service on an "as-is" basis without warranty of any kind including the implied warranties of merchantability and fitness for a particular purpose.
This Agreement is entered into in Europe and shall be governed by, and shall be construed in accordance with, International law.
Using the service constitutes acceptance of these rules.
